Digital-X, LLC (the seller) offers is products exclusively based on the terms of use presented herein. General Terms of Use of the Buyer are hereby rejected and will not apply to any purchase from Digital-X, LLC. Any deviation from the terms herein shall only be binding with written permission from Digital-X, LLC. A contract between the seller and buyer is only final with a written order confirmation through the seller (email sufficient), or the start of fulfilling the order (shipment or delivery).

Payment in full for the ordered Product must be received before delivery of the product will be made possible. Payment through credit card will be the only form of accepted payment until further notice. If the buyer defaults on the due payment the seller is entitled to halt and deny all deliveries from this, or other orders, by the same buyer.

Current pricing can be obtained from our website. Pricing is subject to change without prior notice. Information, data and prices presented on the Internet, in ads, brochures, catalogs and other publications are non-binding and subject to change.

Electronic Transfer (download) via the Internet will be the primary form of delivery for the Product and its Contents. Upon completion of the purchase, the Product files will be made available for download from our server. Should the buyer wish to receive the Product in Disc format (ÒOn-Disc DeliveryÓ), a written request must be made at the time of order. On-Disc Deliveries will incur an additional fee of $5 per disc plus applicable shipping charges.

Binding delivery dates will only be valid after written (email sufficient) request by the buyer and confirmation by the seller. The delivery time can be extended due to work stoppage (e.g. strike), official regulations (e.g. import/export restrictions) or other events beyond the control of Digital-X. After setting an appropriate extension deadline, the buyer has the right to cancel the order if the seller still does not bring about delivery of the ordered products. Further claims cannot be brought against the seller unless bad intent or gross negligence on part of the seller are proven.

Digital-X will attempt to assist any Licensee experiencing a problem with the Product or Contents. If Digital-X is unable to solve the problem adequately, Digital-X will accept a return of the Product and issue a refund for the purchase price of the Product. Notice of non-acceptance must be provided to Digital-X in writing (email acceptable) within two weeks of the order date. The risk (damage or loss) of returning the Product lies with the Buyer. Cost of shipping shall be the responsibility of the Buyer, and Buyer shall insure that the Product is adequately protected within the packaging. If the Buyer received the Product via internet download, all files associated with the Product and all of its Content must be immediately and permanently deleted. Digital-X reserves the right to refuse a return.

Digital-X, LLC processes customer data solely for the purpose of order fulfillment, internal statistical analysis, and to contact customers regarding Product news or special offers through Digital-X itself. Service companies (e.g. banks) receive customer data only to the extent necessary for completion of the order. Digital-X will never sell or otherwise distribute customer information to third parties.
